Pascale Poupelin is a Senior Counsel in the Life Sciences/Healthcare Group in Dentons' Paris office. She has over thirty years of experience as a lawyer specialized in Life Sciences (public and private law). Pascale Poupelin has been highly recommended for many years at French, European and international levels for her expertise in the Life Sciences and Healthcare field.
She mainly acts on matters involving issues such as health products regulations as well as those products regulated from the perspective of health and consumer protection, market access, pricing, reimbursement (all lists), structuring of operational companies, distribution, marketing and licensing, product liability, product compliance, compliance with ethical and professional rules specific to the life sciences and healthcare sector, compliance, clinical trials, contracts/agreements specific to the life sciences and healthcare sector (such as RTU agreements, CEPS agreements, co-promotion agreements, sponsor agreements, distribution agreements, symposium organization agreements, hospital public procurement, etc.). In addition, Pascale also handles the related criminal and consumer law aspects. She is also well-versed in issues including data protection, unfair competition and negotiations/litigation proceedings under the French Social Security Code and French Public Health Code.
Pascale advises major international companies operating in the Life Sciences and Healthcare sector (medicines, biosimilars, medical devices, tissue, cells and blood, veterinary products, cosmetics, nutraceuticals, food ingredients/components, food additives, pesticides, detergents, etc.). She represents them in pre-litigation or litigation matters (on the merits and summary proceedings) before health authorities vested with the power to apply administrative, financial or other penalties (Minister of Health and Social Affairs, CEPS, HAS, ANSM, ANSES, EMA, CNAM, UNCAM, CHMP, etc.), and before a wide variety of courts, such as the civil judge, the commercial judge, the administrative judge, including the Administrative Supreme Court (Conseil d’Etat), the Constitutional Council on an application for a priority preliminary ruling on the issue of constitutionality, the European Court, the Social Security Court and the Regional Compensation Commissions (CRCI).
